Subero Isa calls for care in changing orders on coercive measures
SANTO DOMINGO. The Chief Justice of the Supreme Court of Justice (SCJ), Jorge Subero Isa, called on the judges of the country to not change coercion measures for those accused of criminal acts, without arguments that serve as a basis for such a decision.
The nation's highest magistrate sent a circular advising the magistrates to be highly cautious and in each case giving convincing reasons that justify the change in coercive measures.
Subero Isa, as he issued his opinion, made it clear that he was not trying to invade the areas of competence of the judges, but he just reminded them of the obligation of the judges to reconcile the interests of society and the rights of the accused.
"Without any intention of invading the area of your competence, and yet with the purpose of reminding you of the dispositions of Articles 238, and following, of the Penal Process Code, as well as the obligation of the judges to reconcile the interests of the society with the respect of the rights of the accused", says the circular.
The call by the Chief Justice of the SCJ was made at a time when there are strong questions of decisions that favored persons accused of serious offenses and that have raised complaints from the Justice Department and the National Department of Drug Control (DNCD).
